1. Company Details
These terms and conditions apply to all services provided by OmniShield B.V., registered in the Netherlands at Stadionweg 158, 1077 TA Amsterdam, Chamber of Commerce (KvK) number 95824105. By placing an order or engaging our services, you agree to these terms in full.
2. Services
OmniShield B.V. provides professional plastering, interior finishing, and related construction services. All services are described on our website and are subject to a site assessment prior to commencement.
Prices listed on the website are indicative and based on standard conditions. Final pricing is confirmed in writing following an on-site assessment. Prices are exclusive of VAT unless stated otherwise.
3. Orders and Quotations
Submitting an order via our website constitutes a request for service, not a binding contract. A binding agreement is formed only when OmniShield B.V. confirms the order in writing (by email) and both parties agree on the scope, schedule, and price.
Quotations are valid for 30 days from the date of issue unless otherwise stated.
4. Payment Terms
Payment is due as agreed in the written confirmation. Unless otherwise specified:
- 30% deposit is required before work commences on projects exceeding €500.
- The remaining balance is due within 14 days of project completion.
- Invoices not paid within the agreed term will incur statutory interest under Dutch law (Wet handelsrente).
5. Cancellation and Rescheduling
Cancellations must be made in writing at least 48 hours before the scheduled start date. Cancellations made with less than 48 hours' notice may be subject to a cancellation fee of up to 20% of the agreed project value.
OmniShield B.V. reserves the right to reschedule work due to unforeseen circumstances (weather, material delays, illness). We will notify you as soon as possible and propose an alternative date.
6. Client Obligations
The client is responsible for:
- Providing safe and unobstructed access to the work area.
- Removing furniture, fixtures, and personal items from the work area prior to commencement.
- Ensuring that utilities (water, electricity) are available on site.
- Notifying OmniShield B.V. of any known hazards, including asbestos, damp, or structural issues.
7. Warranty and Defects
OmniShield B.V. guarantees all plastering and finishing work for a period of 12 months from the date of completion, subject to the following conditions:
- The warranty covers defects in workmanship only, not material defects or damage caused by third parties.
- The warranty is void if the surface has been painted, altered, or damaged after completion.
- Hairline cracks resulting from building settlement are not covered.
8. Liability
OmniShield B.V. carries professional liability insurance. Our liability for direct damages is limited to the value of the work performed. We are not liable for:
- Indirect or consequential damages, including loss of income or business interruption.
- Damage caused by pre-existing structural defects not disclosed by the client.
- Damage caused by the client's failure to fulfil their obligations under Section 6.
9. Intellectual Property
All content on this website, including text, images, and design, is the property of OmniShield B.V. and may not be reproduced without prior written consent.
10. Governing Law and Disputes
These terms are governed by the laws of the Netherlands. Any disputes arising from these terms or our services will be submitted to the competent court in Amsterdam, unless mandatory consumer protection law provides otherwise.
Consumers resident in the EU may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
